GENERAL RELEASE AND WAIVER OF DAMAGES
By using this website and requesting services from Carpe Diem Concierge Services, LLC. and/or Kristin Cassen and being of lawful age, I hereby acknowledge and agree for myself and any and all heirs, executors, administrators and assigns to release and discharge Carpe Diem Concierge Services, LLC. and the organizers and providers of entertainment and activities related to this contract and agreement, and all other successors and assigns, and all of their agents and employees; and any and all other persons, firms, insurers, and corporations who are or may be liable, whether they are named or referred to in this Release or not, of and from any and all past, present and future legal actions, causes of action, claims, demands, damages, costs, expenses, compensation, attorneys fees, third-party actions, suits at law or in equity, including claims or suits for pecuniary loss, personal injuries, property damage, loss of comfort and services, wrongful death, consequential damages, contribution and/or indemnity, of whatever nature, known or unknown, on account of, or in any way arising out of or resulting from all claims that were or could have been asserted based upon any incident, accident, or scenario that may or could or will occur with regards to services provided by Carpe Diem Concierge Services,LLC or their agents, assigns, and the activities related thereto.
I acknowledge that this Release is expressly intended to accomplish a NOTICE to me, and any and all of my heirs, executors, administrators and assigns spouse, relatives that the activities and services provided by Carpe Diem Concierge Services, LLC, may be inherently dangerous, could result in serious injury or death, or could result in unusual or unpredictable behaviors by individuals and entities known or unknown to both myself and Carpe Diem Concierge
Services, LLC That by reading this document and requesting service, I am precluded forever
from any claims of any kind, whether at law, at equity, in civil court, family court, or any such jurisdiction, from money damages or any other legal damages that may result from injury, economic loss, financial damages, damages to my reputation, damages to my image or good will, damages to property, both real and personal, or damages to my
character or standing in the community, both local and worldwide. I
declare and represent that in making this General Release I relied wholly upon my own judgment, belief and knowledge of the nature and extent of the use of the services provided by Carpe Diem Concierge Services, LLC and claims, rights and damages that could occur from its use and that I could have obtained the advice of counsel, and that I have not been influenced to any extent whatever by any representations or statements by the persons, firms or corporations being released, or by any person or persons representing them.
This Release contains is an AGREEMENT between the parties, and the terms of this Release are contractual and not a mere recital.
This General Release shall be deemed to have been made under, and shall be governed by, the laws of the Commonwealth of Virginia and any dispute, whether legal or otherwise shall be resolved, litigated or otherwise disposed of under the complete and full jurisdiction of
Virginia. I further state that I have carefully read this Release, that
I understand its contents, and that I participate in the requesting of services as my own free act.
